刑事警察局嚴正呼籲:網路恐嚇與無差別攻擊言論零容忍,切勿以身試法!
近期網路社群平台及各式討論區,陸續出現疑似以恐嚇、鼓吹暴力或宣稱將針對公眾進行「無差別攻擊」等內容之貼文與留言,相關言論已造成民眾不安,影響社會安寧。
刑事警察局在此嚴正呼籲,網路並非法外之地,任何於網路上發布之文字、圖片、影像、語音及訊息等內容,均可能留下數位軌跡與相關紀錄,切勿心存僥倖,以免觸法並須負起法律責任。
刑事警察局強調,對於任何涉及恐嚇社會大眾、散布暴力威脅、煽動或宣稱將對不特定人實施攻擊等言論,將立即啟動偵辦機制,積極追查發文者身分與來源,並依法究責,絕不寬貸、追究到底,以維護公共安全與社會秩序。
刑事警察局並提醒,相關言論可能涉及下列法律責任:
一、刑法第151條「恐嚇公共危安罪」:凡「以加害生命、身體、財產之事恐嚇公眾,致生危害於公安者」,可能構成刑法第151條所定恐嚇公共危安罪,警方將依法偵辦並追究刑責。
二、社會秩序維護法第63條第1項第5款「散佈謠言,足以影響公共之安寧者」:如言論未達前揭刑法程度,然已對社會秩序及公共安寧產生明顯而立即之危險時,仍可能觸犯社會秩序維護法第63條第1項第5款,依法可處3日以下拘留或新臺幣3萬元以下罰鍰。
刑事警察局呼籲社會大眾,切勿以轉傳、附和或以玩笑心態發布相關內容;如發現疑似恐嚇或危害公共安全之貼文、訊息,請保留相關畫面、連結與時間等資訊,並儘速向警方報案(可撥打110或就近至警察機關),共同防範風險、守護社會安寧。

Criminal Investigation Bureau(CIB)Issues Stern Warning: Zero Tolerance for Online Threats and Random Attack Rhetoric; Do Not Defy the Law
 
Recently, posts and comments suspected of containing threats, inciting violence, or claiming to carry out "random attacks" against the public have appeared on social media platforms and discussion forums. Such remarks have caused public anxiety and compromised social tranquility. CIB solemnly warns that the internet is not a lawless land. Any text, images, videos, audio, or messages posted online leave digital footprints and records. Do not defy the law or act under the illusion of anonymity; you will be held legally accountable.
 
CIB emphasizes a zero-tolerance policy toward any speech involving public intimidation, the dissemination of violent threats, or the incitement of attacks against unspecified individuals. CIB will immediately initiate investigations to track the identities and origins of such posts. We will pursue legal responsibility to the fullest extent of the law without leniency to maintain public safety and social order.
 
CIB reminds the public that such remarks may involve the following legal liabilities:
1. Article 151 of the Criminal Code (Offenses Against Public Safety): A person who endangers public safety by putting the public in fear of injury to life, body, or property may be charged under Article 151. The police will investigate and pursue criminal liability in accordance with the law.
2. Article 63, Paragraph 1, Subparagraph 5 of the Social Order Maintenance Act, “Spreading rumors in a way that is sufficient to undermine public order and peace”:
If the remarks do not reach the severity of the aforementioned Criminal Code but pose a clear and immediate danger to social order and public tranquility, they may still violate Article 63, Paragraph 1, Subparagraph 5 of the Social Order Maintenance Act. Violators may be subject to detention for up to three days or a fine of up to NT$30,000.
 
CIB calls upon the public to refrain from forwarding, echoing, or posting such content, even as a joke. If you discover posts or messages suspected of threatening public safety, please preserve the relevant screenshots, links, and timestamps, and report them to the police immediately (by dialing 110 or visiting the nearest police station). Together, let us mitigate risks and safeguard social peace.
